Spanish Right of Withdrawal Policy

This Spanish Right of Withdrawal Policy applies to consumers located in Spain who purchase goods from JMD Mattress through jmdmattress.com. This Policy does not limit any mandatory consumer rights under Spanish law (including Real Decreto Legislativo 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users).

1. Right to Withdraw

If you are a consumer located in Spain, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, receives the goods.
For orders delivered in multiple shipments, the withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, receives the last item.
If the withdrawal period expires on a non-working day (as defined by Spanish law), the deadline is extended until the next working day.

2. How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement before the withdrawal period expires.
You may exercise this right by using the clearly labelled online withdrawal function named "Exercise Spanish Right of Withdrawal" available on our website, customer account area, order status page, or return portal where available.

After receiving an electronic withdrawal request, we will confirm receipt on a durable medium, such as e‑mail.

4. Effects of Withdrawal

If you withdraw from your purchase, we will reimburse payments received from you for the returned goods, including the least expensive standard delivery option offered at the time of purchase (where required by Spanish law).
We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever occurs first.
Refunds will be made using the same payment method used for the original transaction unless you expressly agree otherwise.

5. Return of Goods

You must send back the goods without undue delay and no later than 14 days from the day on which you communicate your withdrawal.
You are responsible for the direct cost of returning the goods unless the return is due to defective, damaged, incorrect, or non‑conforming goods, or unless Spanish law requires otherwise.
For furniture, oversized items, or freight items, return costs may be significant. Please contact us before arranging return shipment so that we can provide appropriate return instructions.

6. Reduction in Refund for Use or Damage

You are responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Furniture should be returned unassembled where possible, with all parts, accessories, hardware, manuals, and original packaging.

7. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to certain goods as permitted by Spanish law, including:

Goods made to the customer’s specifications or clearly personalised;
Sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed;
Goods which, after delivery, become inseparably mixed with other items; and
Other exceptions provided for in Spanish legislation.

8. Defective or Non‑Conforming Goods
